The terms that apply when you buy from us. Plain English, and nothing in here takes away the rights you have under the Australian Consumer Law.
These terms apply when you buy goods from us, whether you order online, by phone or by email. By placing an order you accept them.
We may update these terms. The version that applies to your order is the version published when you placed it.
You are dealing with the trustee for AAA Australian Flag Poles and Flags, ABN 53 197 154 506, trading as Federation Flags and Flagpoles, of Melbourne, Victoria, Australia.
We are a manufacturer. We make our own poles, sew and print our own flags and fabricate our own goal posts.
An order is an offer to buy. A contract is formed when we accept your order, which we do by confirming it to you or by dispatching the goods.
We may decline an order. That includes where the goods are unavailable, where we cannot deliver to your location at a sensible freight cost, where there has been a pricing or description error, or where we cannot verify your payment.
We do our best to describe and photograph our products accurately. Colours can vary between screens, and fabric and finish can vary slightly between production runs.
Prices are in Australian dollars and include GST unless we say otherwise. A tax invoice is issued with your order.
Freight is quoted separately, because it depends heavily on the size of the item and where it is going.
We may change prices at any time, but not after we have accepted your order. If a price is obviously wrong, we will contact you before proceeding rather than simply charging you.
We accept card payment through our payment processor, Stripe, and we can arrange invoiced payment for clubs, schools, councils and approved account customers.
Your card details go directly to Stripe. We never see or store your full card number.
Custom and made to order goods may require payment or a deposit before production starts. We will tell you if that applies to your order.
Goods remain our property until we have been paid in full.
We deliver across Australia. Freight is quoted with your order.
Delivery timeframes we give you are estimates, not guarantees. Custom and made to order goods take longer than stock items, and we will tell you the expected production time when you order.
You need to give us an address where the goods can actually be received. Long items such as tall poles and goal posts are oversize freight and may need suitable access and someone available to help unload.
If nobody is available to receive a delivery and the carrier has to redeliver, the redelivery cost may be passed on to you.
Pickup is available if you would prefer to collect.
Risk in the goods passes to you on delivery. Title passes when we have received payment in full.
If goods are damaged in transit, tell us as soon as you notice and send a photo if you can. We will sort it out with the carrier. Do not sign for a delivery as being in good order if the packaging is obviously damaged.
When you send us artwork for a custom flag, you confirm that you own it or have the right to use it, and that printing it does not infringe anyone else's copyright, trade mark or other rights. You agree to cover us for any claim that arises if that turns out not to be the case.
We may decline to print artwork we consider unlawful, offensive or in breach of someone else's rights.
We send you a digital proof before printing and nothing goes to print until you approve it. Approving the proof means you have checked the spelling, the colours, the sizing and the orientation. Once you approve it, that is what we make, and we cannot remake it free of charge because of an error that was visible on the proof.
Printed colour can vary slightly from what you see on a screen, because screens emit light and fabric does not.
You keep ownership of your artwork. We may show photographs of finished work as examples of what we do, unless you ask us not to.
Contact us as soon as possible if you need to change or cancel an order. We can usually accommodate anything that has not gone into production or onto a truck.
Custom and made to order goods can be changed or cancelled up until you approve the proof or until production starts, whichever comes first. After that, they cannot be cancelled, because they are being made specifically for you.
Faulty, damaged or not as described. We will replace the goods or refund them, and we cover the freight both ways. Contact us and send a photo if you can.
Change of mind. We may accept a return of a stock item in original, unused, resaleable condition and original packaging. Contact us first so we can arrange it. Return freight for change of mind is at your cost, and we may deduct the original outbound freight from the refund.
Custom and made to order goods. These cannot be returned or refunded for change of mind, because they are made specifically for you and cannot be resold. This does not affect your rights if the goods are faulty or are not what you approved.
Refunds are made to the original payment method.
Our goods come with a warranty against defects in materials and workmanship. If a defect appears, contact us with your details, a description and a photo, and we will repair, replace or refund the goods at our option. We cover the cost of claiming under this warranty.
This warranty does not cover fair wear and tear, fading of fabric from ordinary sun and weather exposure, damage from misuse or accident, damage from an installation that was not carried out correctly, modifications made after delivery, or damage from wind or storm conditions beyond the rated loading of the product.
This warranty is in addition to, and does not limit, the rights and remedies you have under the Australian Consumer Law.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law.
Where we are permitted by law to limit our liability, our liability for a failure to comply with a consumer guarantee is limited to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things.
We are not liable for indirect or consequential loss, and we are not liable for loss or damage caused by an installation we did not carry out, by use of a product outside its intended purpose or rated conditions, or by anything outside our reasonable control.
Flagpoles and goal posts must be installed correctly and to the appropriate standard. If you are not installing it yourself, use a qualified installer. If you are unsure what your site needs, ring us before you order.

These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of that state.
If any part of these terms is found to be unenforceable, the rest continues to apply.
